ORDER:

This writ petition is filed for a Mandamus to declare the order in Rc.No.547/2011, dt.10.12.2012, of respondent No.2, whereby he has suspended the petitioner's fair price shop authorization. At the hearing, learned Assistant Government Pleader for Civil Supplies (AP) fairly conceded that in view of amendment of the second proviso of clause 5(7) of the Andhra Pradesh State Public Distribution System (Control) Order, 2008 with effect from 17.9.2012, respondent No.2 has no jurisdiction to pass the impugned order.

In view of the same, the impugned order is quashed and the writ petition is accordingly allowed.

As to sequel to disposal of the writ petition, W.P.M.P. No.49352 of 2012 and W.V.M.P. No.804 of 2013 shall stand disposed of as infructuous. _______________________ C.V. NAGARJUNA REDDY, J 11-6-2015 bnr
