HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.8528 of 2018 ORDER:

This criminal petition is filed under Section 438 Cr.P.C. by the petitioner/ A2, seeking release in the event of his arrest in connection with Crime No.130 of 2018 on the file of Wanaparthy Police Station, Wanaparthy District, registered for the offence punishable under Sections 406 and 420 I.P.C.

Heard learned counsel for the petitioner and learned Public Prosecutor representing the State.

The above crime was registered for the alleged embezzlement of funds of Rs.19,23,000/ -. The very report shows against both accused though finally it shows A1, the Chairman of the Society admitted about the embezzlement and failed to pay. A prima facie perusal of the material no way entitles the petitioner to the concession of anticipatory bail. As none of the offences are punishable above seven years, police strictly follow Section 41-A Cr.P.C.

Accordingly, the Criminal Petition is disposed of rather than dismissal.

Consequently, miscellaneous petitions, if any shall stand closed.
