THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.26611 of 2008 ORDER :

When the matter is taken up for consideration learned counsel for the petitioner as well as respondents submitted that concerning the same subject matter O.S.No.4786 of 2008 is instituted in the Court of VIII Junior Civil Judge, City Civil Court, Hyderabad and the said suit was dismissed. Aggrieved thereby the petitioner filed A.S.No.3/2014 which is pending on the file of XXIV Additional Chief Judge, City Civil Court, Hyderabad.

2. Learned counsel for the petitioner seeks leave of this Court to withdraw the writ petition to prosecute A.S.No.3 of 2014.

3. Permission is accorded.

4. Accordingly, the Writ Petition is dismissed as withdrawn. The dismissal of this writ petition does not come in the way of petitioner prosecuting A.S.No.3/2014. There shall be no order as to costs.

5. Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
