THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.4719 of 2010 ORDER:
This writ petition, under Article 226 of the Constitution of India, is filed seeking verbatim the following relief/s:
'..to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the impugned notification Collector, Karimnagar Proc.No.G1/1822/2007-1 dated 07-06-2007 U/s.4(1) R/w.Section 17(4) of Land Acquisition Act published in Gazetee No.33 dated 08-06-2007 and declaration U/s.6 of the Land Acquisition Act bearing Collector, Karimnagar, Proc.No.G1/1822/2007-2, dated 07-062007, published in gazette No.37, dated 4-7-2007 to acquire petitioners' lands to an extent of Ac.3.00 acres, Ac.2-02 guntas, Act.1-29 guntas and Ac.1.29 guntas in Sy.No.461, situated at Nampalli Village, Vemulawada Mandal, District Karimnagar respectively as illegal, arbitrary, contrary to law and in violation of Articles 300-A of the Constitution of India and consequently set aside the same to an extent of our lands and to pass such other order or orders..'
I have heard the submissions of Smt. P. Bhavana Rao, learned counsel for the petitioners, and of the learned Government Pleader for Land Acquisition, appearing for respondents.
At the hearing, it is submitted that the subject matter and the issue involved in the present writ petition are squarely covered by the order, dated 23.03.2018, of this Court, in WP.No.19352 of 2007. A copy of the said order is placed on record. By the said orders, the afore-said writ petition was allowed and the notification under Section 4(1) and declaration under Section 6 of the Land Acquisition Act, 1894 were set aside. Pursuant thereto, the Revenue Divisional Officer, Sircilla, addressed a letter, dated 12.06.2018, vide reference
no.A1/493/2007, to the Sub-registrar, Vemulawada, intimating that the lands covered by the orders in the afore-stated writ petition as well as the subject lands have been deleted from acquisition.
Having regard to the submissions and for the reasons alike as were mentioned in the orders, dated 23.03.2018, in WP.No.19352 of 2007, this Writ Petition is also allowed in terms of the said order. There shall be no order as to costs.
