Lal Mohammed, v. Sri Prasanna Sinha,
THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO CONTEMPT CASE.No.958 of 2014 O R D E R:
At long last, the Chief Medical Officer of the Singareni Collieries Company Limited has appeared in the Court today. A counter-affidavit has also filed on his behalf by the learned Standing Counsel for the Singareni Collieries Company Limited explaining the reasons for his absence on previous occasion as well as the reasons for not complying with the Court order promptly. Be that as it may, the order has been passed by the Chief Medical Officer on 22.04.2015. Therefore, the petitioner has to work out his remedies with regard to the said order.
For the reasons set out in the affidavit, I consider that the matter calls for some lenient view to be expressed in the matter. Accordingly, the contempt case is dismissed recording the trust and hope of this Court that the respondent will henceforth be more careful. No costs.
In view of the dismissal of the contempt case, no further action is needed to be taken on the warrant issued against the respondent. _______________________________________ JUSTICE NOOTY RAMAMOHANA RAO 28.04.2015.
