HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 30915 of 2017 Order:

This Writ Petition is filed challenging the order dated 20.06.2017 passed by the first respondent and the consequential order passed by the second respondent on 29.06.2017 with regard to constructions being made by the petitioner in the land in Survey No.690/1 of Nandipet village and Mandal, Nizamabad District.

It appears that one Karre Ushanna, S/o Gangaram lodged a complaint with the first respondent stating that the petitioner occupied his land and raising a shed by changing the house number. It appears that O.S.No.86 of 2016 was filed before the Junior Civil Judge, Armoor, Nizamabad District by one Karre Gangaram @ Gosam Gangaram in respect of the same property. In view of the pendency of the Civil Suit, the first respondent passed an order on 20.06.2017 staying the construction permission already issued in their favour. The second respondent passed a consequential order on 29.06.2017, in view of the orders passed by the first respondent on 20.06.2017. In view of the pendency of the Civil Suit, it is for the parties to work out their remedies in accordance with law. Further, the petitioner has not impleaded the plaintiff in the said suit and the complainant before the first respondent in the present proceedings.

In view of the same, the Writ Petition is not maintainable and the same is, accordingly, dismissed at the admission stage giving liberty to the petitioner to take appropriate proceedings in accordance with law. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
