THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.1154 OF 2016 ORDER:

This contempt case is filed alleging non-implementation of the order of this Court dated 27.10.2014 passed in W.P.No.24376 of 204, wherein this Court directed the second respondent to verity the record and take necessary steps in accordance with the provisions of the A.P.Municipalities Act, 1965 for payment of compensation to the petitioners for the land affected in laying road from Subhash Road to Railway Feeder Road covering Plot Nos.6 and 13 belonging to the petitioners. The second respondent was given six months time from the date of receipt of a copy of the said order.

Now the second respondent is present and filed a counter affidavit stating that there was a change in the Standing Counsel and in view of the same, they could not file an Appeal, but they filed Appeal with delay in W.A. (SR) No.65344 of 2015, which is yet to be numbered. He further states that after appointing as Commissioner, Municipal Corporation, Ananthapuram, he verified the records and noticed that some facts were not brought to the notice of this Court and accordingly, after verifying the records, he issued an Endorsement on 09.10.2017 asking the petitioners to submit certain documents in order to decide the matter. The petitioners are yet to submit the required documents. In view of the same, no further proceedings in the contempt case are warranted. However, the second respondent shall pass appropriate orders after submitting the required documents by the petitioners as expeditiously as possible, but not later than two months. It is needless to observe that the petitioners shall furnish the required documents as per the Endorsement dated 09.10.2017.

The contempt case is accordingly closed.
