Smt Gundavarpu Sumithra, v. The State Of Telangana, Rep By Its Principal Secretary,
HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.33698 of 2016 ORDER:
This writ petition is filed for a writ of mandamus declaring the action of respondents 2 & 3 in interfering in the civil dispute and threatening to dispossess the petitioners from their land admeasuring Ac. 0.11 guntas, covered by compound wall in Survey No.85, situated at Raidurgh Pan Maqta Village, Serilingampally Mandal, Ranga Reddy District as illegal and arbitrary. Heard and perused the material available on record. The grievance of the petitioners is that the 3rd respondent is interfering in the civil dispute between the petitioners and the 4th respondent, even though there is no complaint against the petitioners alleging any cognizable offence.
Considering the grievance of the petitioners, the Writ Petition is disposed of with the following direction:
The 3rd respondent is directed not to interfere with the affairs of the petitioners and the 4th respondent, more particularly, with the civil disputes pending between them. However, this Order will not stand in the way of the 3rd respondent to register a case, if any complaint is lodged against the petitioners for cognizable offence. Accordingly, the writ petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ RAJA ELANGO, J Date: 17th October, 2016 KL
