THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7209 OF 2017 ORDER:

This Writ Petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the respondent Nos. 1 to 3 in interfering with the social activities which are being conducted by the petitioner in EE-type quarter situated in Jaggaiahpet town, Krishna District which is let out to the petitioner without following due process of law as arbitrary and illegal and consequently direct the respondents not to interfere with the social activities of the petitioner in EE-type quarter which was let out to the petitioner vide proceedings No.AB/A6/B-5/329 M, dt.04-05-2005 issued by the 2nd respondent."

This writ petition is filed questioning the action of the Irrigation Department. The petitioner herein already instituted a suit vide O.S.No.33 of 2015 on the file of Junior Civil Judge, Jaggaiahpet Town, Krishna District and the same is pending consideration. Since the suit is pending, this Court is not inclined to entertain the present Writ Petition.

In view of the same, the Writ Petition is disposed of, keeping it open to the petitioner to seek appropriate relief in the pending suit, if he is so advised.

Miscellaneous petitions, if any, pending shall stand closed. No costs.
