CVNR, J CC 1653/2016 ORDER:

This contempt case is filed alleging wilful disobedience of order dt.27.01.2016 in W.P. No.2154 of 2016.

At the hearing, Mr. Sriman, learned counsel for the petitioner, submitted that though in purported compliance with the aforementioned order, the respondent has furnished a survey report, the same was not in accordance with order dt.14.8.2015 in W.P. No.25834 of 2015.

A perusal of the order passed by this Court in W.P. No.2154 of 2016 shows that no specific reference to the date of the survey report was made therein. Therefore, if the survey report different from the one as directed to be furnished to the petitioner in W.P. No.25834 of 2015 was furnished by the respondent, the contempt petition would lie for the alleged disobedience of the said order, i.e., order dt.14.08.2015 in W.P. No.25834 of 2015.

In this view of the matter, this contempt case is dismissed, however, with liberty to the petitioner to avail the remedy of filing a fresh contempt case in terms of the above observations.
