THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12934 of 2025 ORAL ORDER:
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.2, 3, 5, 8 and 10 in Crime No.252 of 2025 before the Thorrur Police Station, Mahabubabad District. 2.
The brief facts of the case are that on 18.08.2025, the de facto complainant lodged a report before the police stating that on 23.07.2025, he had a love marriage with his villager, Lavanya,. Accordingly, the police called both parties and conducted counseling. Thereafter, the parents of his wife, Yeshboina Ramulu and their son Sai Kumar, along with others, threatened him. The accused formed themselves into an unlawful assembly, armed with kitchen knives and sticks, with an intention to eliminate LWs 1 to 3. They disconnected the streetlight power supply, illegally trespassed into the house of LW-1, and attempted to attack him with the intention to kill him and take back LW-2. When LWs 1 and 2
went inside the house and bolted the door, A-1 to A-3 and A-5 to A-10, as per their pre-plan and common intention, attacked LWs 2 and 3 with deadly weapons. Hence, the complainant requested the police to take necessary action. 3.
Heard Sri H. Venugopal, learned Senior Counsel representing Smt. D. Shaila, learned counsel appearing on behalf of the petitioners as well as Sri E. Ganesh, learned Assistant Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the alleged allegations and, in fact, they themselves sustained injuries. He further submitted that the main allegations are against accused No.1, and there are no such allegations against the petitioners, even as per the prosecution witnesses. He contended that the material part of the investigation has been completed and that the other accused in the same crime have already been granted regular bail by this Court. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition.

On the other hand, learned Assistant Public Prosecutor opposed the bail stating that the allegations leveled against the petitioners are serious in nature, as such, the custodial interrogation of the petitioners is required. Further, the investigation was not yet completed. At this stage, granting of pre-arrest bail to the petitioners does not arise. Therefore, he prayed the Court to dismiss the criminal petition. 6.
In light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it appears that the petitioners are arrayed as accused Nos. 2, 3, 5, 8, and 10. As seen from the remand report, the main allegations against the petitioners are that they attacked LWs 3 and 4. Further, as per the medical report filed by the Public Prosecutor, it appears that the said witnesses sustained only simple injuries. Considering the facts and circumstances of the case, this Court deems it fit to grant prearrest bail to the petitioners, subject to the following conditions:
i.
The petitioners shall surrender before the Station House Officer, Thorrur Police Station, Mahabubabad District, within two weeks from today, and on
such surrender, the said Station House Officer shall them on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
