Heard.
The petitioner claims to be the successor to her father-in-law, who was granted D-form patta in the year 1977, and has sought for survey by approaching the 4th respondent under an application, dated 08-05-2006. The petitioner also claims to have paid the requisite fee. The grievance of the petitioner is that the 4th respondent is trying to interfere with her possession and seeks to assign the said land to somebody else.
It is evident from the averments of the petition that though Succession to her father-in-law is claimed, there appears to be no mutation in her name. The petitioner, therefore, will have to first get a succession in her favour to be declared by appropriate proceedings and then seek appropriate further directions.
Hence, with a liberty to the petitioner to take necessary action in accordance with law, the writ petition is disposed of. No costs Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
