HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION NO.8383 of 2015 ORDER:

This writ petition is filed questioning the construction that is being made by the unofficial respondents 3 to 8.

The writ petition is disposed of at admissions stage with the consent of both the parties.

The case of the petitioner is that due to construction that is being made by the unofficial respondents, the road is reduced to 18 feet and the rain water lane is also occupied and that the rain water is flowing abutting the doors of the petitioner.

Learned standing counsel appearing for respondents 1 and 2 submits that if the petitioner gives a fresh representation, the respondents will take appropriate action.

Learned counsel for the petitioner also agrees to give a fresh representation setting out his grievance.

In view of the same, the Writ Petition is disposed of giving liberty to the petitioner to submit a fresh representation before the 2nd respondent setting out his grievance, and if any such representation is filed by the petitioner, the 2nd respondent is directed to consider and pass appropriate

orders thereon within a period of six weeks from the date of receipt of the said representation. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed. _____________________________ KONGARA VIJAYA LAKSHMI, J Date: 26/11/2018 lkv
