THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2029 OF 2015 ORDER:

This Criminal Revision Case is filed by the petitioner, challenging order, dated 07.04.2015, passed in Crl.A. No.48 of 2014 in by the VIII Additional District and Sessions Judge, Chittoor, whereby the learned Judge has enhanced the maintenance passed by the III Additional Judicial Magistrate of First Class, Chittoor vide order, dated 03.03.2014, in Crl.M.P. No.1929 of 2013 in DVC No.20 of 2013. The 1st respondent is the wife and the 2nd respondent is the daughter of the petitioner. They filed DVC No.20 of 2013 before the III Additional Judicial Magistrate, Chittoor against the petitioner. They also filed Crl.M.P. No.1929 of 2013 before the trial Court against the petitioner seeking interim maintenance at Rs.20,000/- per month to the 1st respondent and Rs.10,000/-per month to the 2nd respondent, pending disposal of the main case.

The trial Court partly allowed the said application granting interim maintenance at Rs.3,000/- per month to the 1st respondent and 2,000/- per month the 2nd respondent. Aggrieved by the same, the 1st respondent filed Crl.A. No.48 of 2014 before the VIII Additional District & Sessions Judge, Chittoor. The learned appellate Court allowed the appeal and enhanced the interim maintenance to Rs.6,000/- per month to the 1st respondent and Rs.4,000/- to the 2nd respondent through the order impugned. Challenging the same, the present revision is filed.

Heard and perused the material available on record. Having regard to the facts and circumstances of the case, without expressing any opinion on the merits of the case, this Criminal Revision Case is disposed of modifying the order under revision, as

follows:

The petitioner is directed to pay interim maintenance at the rate of Rs.3,000/- per month to the 1st respondent and Rs.4,000/- to the 2nd respondent from the date of the above application till disposal of DVC. He is also directed to pay the said maintenance amount on or before 10th of every succeeding month and the arrears if any, within three months from the date of receipt of a copy of this order. The trial Court is directed to dispose of the DVC, as expeditiously as possible preferably within a period of six months from the date of receipt of a copy of this order, without being influenced by this order and the order under revision.

Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
