THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.42674 of 2015 ORDER:

The petitioner - society applied to the National Council for Teacher Education (NCTE) for permission to offer a two year D.El.Ed. course from the academic year 2016-2017.

By order dated 17.11.2015, the NCTE rejected the petitionersociety's application on the ground that it had failed to file a hardcopy of the application within the stipulated timeframe. Perusal of this order reflects that an appeal is provided thereagainst under Section 18 of the National Council for Teacher Education Act, 1993. As an efficacious alternative remedy is provided by the statute itself, this Court is of the opinion that it would not be open to the petitioner - society to invoke its extraordinary jurisdiction by way of a writ petition in the first instance.

In that view of the matter, the writ petition is disposed of permitting the petitioner - society to present an appeal in accordance with law within two weeks from the date of receipt of a copy of this order. In the event such an appeal is filed, the appellate authority shall strive to dispose of the same expeditiously and in any event, not later than four (4) weeks from the date of receipt of such appeal.
