Aggrieved by the inaction of respondents 4 and 5 in conducting the investigation in Cr.No.101 of 2017 of Tirupati East Police Station, the present writ petition is filed. Learned Assistant Government Pleader for Home submits that initially the final report was filed after investigation of the crime. But again on the representation of the petitioner, the case was reopened and investigation was ordered and the same is in progress. He further submits that the respondent-police require three months time for filing final report.
Learned counsel for the petitioner submits that though crime is registered in the year 2017, the respondent-police have not arrested the accused. Serious crime is registered under Section 376 (2) (i) and Section 8 of POSCO Act. When such a serious crime is registered, the respondents are bound to complete the investigation by taking appropriate action in accordance with the provisions of Cr.P.C. especially keeping in view the spirit under Section 173(1) Cr.P.C.
In view of the same, this writ petition is disposed of directing the respondent-police to take appropriate action in the matter and file final report within a period of two months from the date of receipt of a copy of this order. As a sequel to
the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
