HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.785 of 2014 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents. The prayer sought in the writ petition is as under: "... to issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the 2nd respondent in calling the petitioner to the police station and forcing the petitioner to say in police station is illegal, arbitrary and against law and consequently direct the respondents not to call the petitioner and his family members without following any due process of law."

During the course of arguments, learned Government Pleader placed on record written instructions dated 14.10.2019 issued by the Station House Officer, Saifabad Police Station, Hyderabad.

From a perusal of the said written instructions, it is revealed that on 12.03.2009 a rowdy sheet was opened against the petitioner as he was causing breach of peace and tranquility in the area and also for his involvement in Crime No.621 of 2008 under Sections 147, 148, 324 read with 149 IPC of Saifabad Police Station. As the said rowdy sheet was maintained at Saifabad Police Station, bind over orders were passed for keeping good behaviour. It is also mentioned in the written instructions that since the petitioner is leading a peaceful life, the rowdy sheet opened against him was closed on 04.11.2015 and he was never called to the police station

and the 2nd respondent never interfered with his life and liberty.

In the light of the above said facts and circumstances, this Court is of the opinion that no further cause would survive in the writ petition.

Accordingly, the writ petition is closed. No order as to costs.
