HONOURABLE SRI JUSTICE S.V.BHATT WRIT PETITION No. 5890 of 2016 ORDER:

Heard learned Counsel for the petitioner and learned Assistant Government Pleader appearing for the respondents. The petitioner through this Writ Petition complains against inaction of respondents in preventing unauthorized and illegal constructions undertaken by one Shalu Bee, W/o Pedda Basha/7th respondent in the Writ Petition, in spite of representation dated 15.02.2016 submitted by him. The petitioner is the Sarpanch of Narsapuram Grampanchayat. The grievance of the petitioner canvassed before the authorities is that the seventh respondent has encroached into the Government land adjoining her plot and

making illegal and unauthorized constructions. In the process, it is further alleged that the seventh respondent has rendered bore-well in existence in the encroached land ineffective or preventing the villagers from using the bore-well. In the case on hand, the allegations are that the seventh respondent is not only undertaking unauthorized and illegal constructions but also rendered ineffective the bore-well in existence in the encroached land and removed the tap fixed by the Grampanchayat in Sy.No.254/2A. Hence the Writ Petition is disposed of with the following order:

The petitioner is given liberty to communicate a copy of this order along with representation dated 15.02.2016 to second and third respondents within one week from today. The second and third respondents are directed to enquire into the allegations made against the seventh respondent, if necessary conduct an enquiry and take appropriate action in accordance with law within a further period of four weeks thereafter.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
