THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 23335 of 2016 ORDER :

This Writ Petition came to be filed with the following prayer: "issue an appropriate writ, order or direction more in the nature of Mandamus Writ of Mandamus declaring the action of the 2nd respondent in interfering with the rights of the petitioners at the instance of respondents 3 and 4 yielding to the pressures brought out by them through their political identities and trying to settle the civil dispute even though he do not have any authority, as being illegal, arbitrary and is in violation of principles of natural justice and established judicial precedents, and consequently direct respondent No.2 not to interfere with the dispute between the petitioners and respondents 3 and 4 and harass the petitioners by infringing the fundamental rights of the petitioners guaranteed under Constitution of India."

Heard learned counsel for the petitioners and the Assistant Government Pleader for Home for the State of Telangana appearing for respondents 1 and 2. At the request of both counsel, the writ petition is being taken up for disposal at the stage of admission. Since this Court is not adjudicating the case on merits, it may not be necessary to hear respondent Nos.3 and 4.

The case of the petitioners is that respondents 3 and 4 are owners of land to an extent of Ac.0.21 guntas in Survey No.44/1 of Miyapur Village, Serilingampalli Mandal, Ranga Reddy District and that they entered into an agreement of sale with the petitioners without any time limit and received the sale consideration, but in spite of causing legal notice dated 2.12.2015 respondents 3 and 4 are not coming forward to execute the registered sale deed. It is submitted that at the instance of respondent Nos.3 and 4, respondent No.2 is interfering with the civil disputes between the petitioners and

respondent Nos.3 and 4. Hence, this petition is filed. Learned Assistant Government Pleader, on instructions submitted that the allegations in the writ petition are false and the respondent-police are not interfering in civil disputes and they are acting in accordance with law.

Recording the said submission, the Writ Petition is disposed of making it clear that any action taken by the police shall be in accordance with law.
