O R D E R
This writ petition was filed with the following prayer: 'For the reasons stated in the accompanying affidavit it is prayed that this Hon'ble Court may be pleased to issue a Writ or order or direction more particularly one in the nature of Writ of mandamus declaring the action of the respondent No.3 in trying to discontinue the agencies of the petitioners as implementing Agencies of Mid-Day meal programme in the 4th respondent school, without issuing any notice or terminating orders to the petitioners as bad arbitrary, illegal and violation of principles of natural justice and consequently direct the respondents to continue the petitioners as cooks/implementing agencies of Mid - Day meal programme in the 4th respondent school in the interest of Justice.'
By order dated 19.11.2013, this Court directed maintenance of status quo with regard to operation of the mid-day meal agency in Ibrahimpatnam Mandal, Karimnagar District. No counter-affidavit has been filed, but the learned Government Pleader for Education, State of Telangana, states that the writ petition was filed on a mere apprehension and that there was no threat of discontinuance of the services of the petitioners even as on the date of the institution of the writ petition.
In that view of the matter, the writ petition is closed leaving it open to the authorities to follow the due procedure in the event they contemplate discontinuance of the services of the petitioners, if warranted. Interim order dated 19.11.2013 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
