THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY Tr.CMP No.699 of 2015 ORDER:

This petition is filed under Section 24 of CPC seeking to withdraw H.M.O.P.No.165 of 2015 pending on the file of the Principal Senior Civil Judge, Machilipatnam and transfer the same to the Court of the Senior Civil Judge, Kakinada, East Godavari District. At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the learned Principal Senior Civil Judge, Machilipatnam to dispose of the HMOP No.165 of 2015 as expeditiously as possible.

In view of the submissions made by the learned counsel for the petitioner, this court is not inclined to go into the merits of the main case.

Having regard to the submission made by the learned counsel for the petitioner the learned Principal Senior Civil Judge, Machilipatnam is hereby directed to dispose of the HMOP No.165 of 2015 pending on its file as expeditiously as possible, preferably, within a period of three months from the date of receipt of a copy of this order.

This petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending in this Tr.CMP shall stand closed.
