This Writ Petition is filed questioning the notice dated 21.03.2017 issued by the 2nd respondent.

Since the impugned order being only a notice and as the petitioner had already submitted a representation dated 27.03.2017, to the Commissioner, Nagar Panchayat-2nd respondent, the interest of justice would be served if a direction is given to the 2nd respondent not to take any coercive steps, including the demolition of the compound wall, without considering the representation dated 27.03.2017 submitted by the petitioner and thereafter passing a speaking order.

Accordingly, the writ petition is disposed of directing the 2nd respondent not to take any coercive steps, including the demolition of the compound wall, without considering the representation dated 27.03.2017 submitted by the petitioner and thereafter passing a speaking order. There shall be no order as to costs. Consequently, miscellaneous petitions pending, if any, shall also stand dismissed.
