This Writ Petition was filed challenging the action of the 2nd respondent in not allowing the petitioner to open eprocurement tender notification dated 29.6.2017. A tender notice was issued under e-procurement short term basis for execution of works to the tune of Rs.192.50 lakhs and the last date was indicated as 7.7.2017 at 5.00 p.m. It was stated that the tenders would be opened at 5.30 p.m. on 7.7.2017.
In the affidavit filed in support of the Writ Petition it is stated that the tenders were opened on 10.8.2017 without information to the petitioner. He approached this Court stating that the respondents 2 and 3 may finalize the tenders on any date.
The present Writ Petition has been coming up for consideration from 24.8.2017 and there was no interim order. In the absence of any interim order, the prayer in the Writ Petition has become infructuous.
Accordingly, the Writ Petition is closed keeping the right of the petitioner open in respect of other reliefs, if any.
Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
