HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.28763 OF 2018 O R D E R :

The only grievance of the petitioner is that the respondent police are forcing the petitioner to give an undertaking that he will vacate the house bearing No.79/1571-A2, Krishna Nagar, Kurnool. He also submits that petitioner filed claim petitioner in EA.No.198/2018 before the Executing Court and the same is pending.

On the other hand learned Assistant Government Pleader for Home produced written instructions stating that the respondent police never called the petitioner to police station at any point of time and forced him to vacate the subject house; that in pursuance of the direction given by the Senior Civil Judge Court, Kurnool, on 01.05.2018 in EA.No.112/2018 in EA.No.77/2018 in EA.No.403/2015 in EP.No.164/2015 in OS.No.129/2010, to deliver the subject property to the 4th respondent by giving police aid by 02.07.2018, one Sri U.Krishna Murthy Raju, SI of Police, Kurnool IV Town P.S, followed by Court Amina, went to the subject house on 13.05.2018 and found the same locked. It is also stated that the 4th respondent lodged a complaint against the petitioner on 11.08.2018 and the same was registered as Crime No.332/2018; that there appears to be civil disputes between the petitioner and 4th respondent; and that the

respondent police only acted as per the court direction in EA.No.112/2018.

It is to be seen that when there is a direction from the Civil Court, it is for the respondent police to act on the same. If petitioner has any grievance he has to work out his remedy before the executing Court. More so, it is stated that petitioner has already filed EA.No.198/2018.

In view of the same, recording the submissions made by the learned Assistant Government Pleader, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 14.08.2018 t k.
