This criminal petition is filed, by the petitioners, who are the accused, seeking for quash of the proceedings against them in C.C.No.131 of 2013 on the file of the court of III Additional Chief Metropolitan Magistrate, Vijayawada, Krishna District. The offences alleged are under Sections 379, 406, 411, 465, 471, 120-B and 506 r/ w 34 IPC.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the 1st respondent as well as the counsel appearing for the 2nd respondent.

The counsel for the petitioners fairly submits that he does not press upon the grounds of the petition, but he seeks a direction to be given to the court below not to insist upon the presence of the petitioners.

Recording the said submission, the Criminal Petition is dismissed and the court below is directed not to insist upon the presence of the petitioners unless they are necessary for the proceedings of the case.

As a sequel, the miscellaneous applications pending, if any, shall stand closed.
