THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos. 9677 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime Nos. 332 of 2022 on the file of Station House Officer, Chevella Police Station, Cyberabad, registered for the offence punishable under Sections 417, 376, 420 of Indian Penal Code.

Heard learned counsel for the petitioner/Accused and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The complaint of the defacto complainant is that she was having acquaintance with the petitioner over a period of 4 years. They met each other on the basis of paper advertisement given by this petitioner for prospective bride. Being acquainted over the period, the petitioner allegedly promised that he would marry the defacto complainant and also assured her that her son gets his job after his retirement. Further he has taken a total amount of Rs. 18,00,000/- from her on different dates.

As seen from the allegations in the complaint, the petitioner and the defacto complainant had consensual relation. However, for the reason of taking money according to the complaint, defacto complainant was aggrieved. The petitioner was arrested on 13.09.2022 and further five witnesses were examined during the course of investigation apart from the seizures that were made. Since, the investigation is almost complete, the prayer for regular bail can be considered on conditions.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions:

i) The petitioner/Accused is directed to be released on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties each for a like sum, to the satisfaction of Judicial First Class Magistrate at Chevella, Ranga Reddy District.

ii) After release on bail, the petitioner/Accused shall appear before the concerned police station on every alternative day till filing of the charge sheet.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
