HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 25014 of 2015 ORDER:

The petitioner was appointed as a fair price shop dealer of shop No.27, Palaparru Village, Pedanandipadu Mandal, Guntur District. She was also given incharge of shop No.19 of Rajupalem Village. She distributed commodities as an incharge dealer for the months of October, November and December, 2014. Thereafter, she did not continue as an incharge dealer. While so, proceedings were issued by the second respondent suspending the authorisation of the petitioner on 22.04.2015 on the basis of the report submitted by the third respondent dated 16.04.2015. The petitioner submitted her explanation on 05.05.2015. The petitioner filed the Writ Petition challenging the action of the second respondent in suspending the authorisation.

A perusal of the allegations, in the impugned order, shows that they relate to certain irregularities when the petitioner continued as an incharge dealer of shop No.19 during the months of October, November, December, 2014. Since the enquiry in respect of the said allegations is pending before the second respondent for the last three months, this Court is not inclined to interfere with the same. However, the second respondent is directed to complete the enquiry, by giving due opportunity to the petitioner, and pass final orders thereon, within a period of thirty days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
