HON'BLE SRI JUSTICE SURESH KUMAR KAIT CIVIL REVISION PETITION No.4734 of 2018 ORDER:

This civil revision petition, under Article 227 of the Constitution of India, is filed questioning the order dated 02.07.2018 passed in I.A.No.275 of 2018 in O.S.No.217 of 2010 by the I Additional District Judge, Guntur, whereby the application filed by the respondent herein under Order 16 Rules 1 (2) (3) CPC, has been allowed and summons were directed to be issued to the witnesses on payment of process. After arguing for some time, it is conceded by the learned counsel for the parties that the respondent herein may be allowed to lead evidence first and thereafter the petitioners shall lead further evidence rebutting the evidence of the respondent herein. In that view of the matter, this civil revision petition is disposed of directing the respondent herein to lead evidence at first instance and thereafter the petitioners shall lead further evidence while rebutting the evidence to be led by the respondent herein.
