THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9653 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.3 in Crime No.153 of 2022 pending on the file of Station House Officer, Dabeerpura Police Station, Hyderabad registered for the offences punishable under Sections 307, 452, 384, 506 read with 34 of Indian Penal Code (for short 'IPC').

Heard learned counsel for the petitioner/Accused No.3 and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The Police Dabeerpura is investigating the case which is registered on the basis of the complaint filed by the de facto complainant alleging that on 29.09.2022, Accused No.1 picked up a fight with witnesses and thereafter he called Accused Nos.2 to 7 and all of them assaulted the de facto complainant and others.

As seen from the allegations, it was an altercation that ensued between the witnesses and the accused. There is no specific allegation attributed to this petitioner, except stating that he was part of seven members who had attacked the victim. Keeping in view that the petitioner is a student, he can be granted the relief of regular bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.3 is granted bail subject to the following conditions:

i) The petitioner/Accused No.3 is directed to be released on bail on his executing personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to the satisfaction of VIII Additional Chief Metropolitan Magistrate, Hyderabad.

ii) After release on bail, the petitioner/Accused No.3 shall appear before the concerned police station on every Monday between 10.00 A.M and 01.00 P.M, for a period of six (06) weeks and thereafter as and when required for the purpose of investigation.

iii) The petitioner/Accused No.3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 09.11.2022 rev/tu
