THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No. 24355 of 2016 ORDER:

Vide the present petition, petitioner seeks direction thereby directing respondents 2 and 3 to delete his land admeasuring Ac.1-243⁄4 guntas in Survey No.318 of Kukkalgudur village, Ramagundam mandal, Karimnagar district, from acquisition.

2. Heard learned counsel for the petitioner and the learned Government Pleader for Revenue, for the respondents.

Learned counsel for the petitioner has drawn the attention of this Court to the communication dated 01.04.2016 from the Office of the Collector, Karimnagar to the Revenue Divisional Officer, Peddapally, wherein it is stated that an extent of 0.09 guntas may be procured under G.O.Ms.No.123 for the purpose of R&R colony and the remaining extent of Ac.1-153⁄4 guntas may be deleted from the acquisition. Learned counsel submits that the petitioner has requested the respondents to delete his land from acquisition, in view of the communication dated 01.04.2016, however, till date the respondents have not taken any steps.

In that view of the matter, I direct the respondent Nos.2 and 3 to consider the writ petition as a representation of the petitioner, and decide on the request of the petitioner with regard to deletion of his aforesaid land from acquisition, within two weeks from the date of receipt of a copy of this order, and

communicate the decision to the petitioner, in writing, within a week thereafter.

5. With the above direction, the writ petition is disposed of. No costs. Miscellaneous petitions, if any pending, shall stand closed.
