HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.19 OF 2016 ORDER:

This criminal petition under section 438 of the Code of Criminal Procedure is filed by the petitioners-A.1 to A.4 seeking anticipatory bail in connection with Crime No.155 of 2015 on the file of Devanakonda Police Station, Kurnool District registered for the offences under Sections 427, 447, 323, 506 r/w 34 IPC.

The allegation against the petitioners herein is that they have sold away the land assigned in favour of the de facto complainant and in that connection, the complainant made a complaint to the revenue officials, and having grudge over the same, on 20.12.2015, at about 11.00 a.m., they trespassed into the land of the complainant, beat him with sticks, fists and legs and they threatened him with dire consequences.

Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

Admittedly, the case is arising out of land dispute between the parties. Considering the same, this Court is inclined to grant anticipatory bail to the petitioners herein.

Hence, the petitioners-A.1 to A.4 are directed to surrender before the Magistrate concerned on or before 02.02.2016 and on such surrender, they shall be enlarged on bail on each of them executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety each for the likesum to the satisfaction of the Magistrate concerned. Further the petitioners are directed to report before the S.H.O. concerned daily between 10.00 a.m. and 5.00 p.m. for a period of fifteen days.
