HACJ & ARRJ W.P. No.29003 of 2018 ORDER: (per the Hon'ble the Acting Chief Justice Raghvendra Singh Chauhan) Aggrieved by the non-sanctioning of the requisite funds for deposit of 50% of the enhanced decretal amount towards land acquisition compensation, in compliance with the orders of this Court dated 30.09.2015, in L.A.A.S.M.P.No.969 of 2015 in L.A.A.S.No.291 of 2015, the petitioners have approached this Court.
According to the order dated 19.12.2018, the respondents had sought for eight weeks time for depositing 50% of the enhanced decretal amount. An undertaking was also given that the controversy between the State of Andhra Pradesh and the State of Telangana would be resolved within the said period. By the said order, this Court had directed the respondent No.2, the State of Andhra Pradesh, to draw up a Demand Draft in the name of the Special Deputy Collector, Land Acquisition (Pulichintala Project, Unit-6, Kodad) towards 50% of the compensation amount positively on or before 03.01.2019, and to handover the said Demand Draft to the Special Deputy Collector, Land Acquisition. However, as the said direction was not complied with, this Court had taken a serious view on 20.03.2019. On 30.04.2019, the respondent No.2 had informed this Court that steps have been taken for depositing the said amount. However, the learned counsel sought one day's time before he makes an effective statement at the Bar.
HACJ & ARRJ W.P. No.29003 of 2018 Today, Mr. Raja Sripathi Rao, the learned Government Pleader for Land Acquisition of Telangana appearing for respondent No.7, has submitted an affidavit of Mr. L.Vijaya Chander, the Special Collector (Land Acquisition), wherein it is stated that the steps are being taken for depositing the said amount. He further states that by letter dated 30.04.2019, written by the Revenue Divisional Officer, Kodad, to the Branch Manager, SBI, Kodad, directions have been issued to the Branch Manager to draw up a Demand Draft for an amount of Rs.2,27,98,338/- . The learned counsel gives an undertaking before this Court that the said amount shall be deposited before the Executing Court by 03.05.2019. Since the said undertaking has been given by the learned counsel, it is hoped that the undertaking will be carried out. In case, the undertaking is not implemented by 03.05.2019, the petitioners shall be free to immediately file a contempt case before this Court.
With these directions, the writ petition stands disposed of.
