HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.28780 OF 2018 ORDER:

When the matter is taken up for hearing, counsel for the petitioner had contended that the case of the petitioner for promotion to the post of Administrative Officer is not being considered on the ground that suspension period is not being regularized, even though the disciplinary proceedings initiated against the petitioner have been dropped vide G.O.Rt.No.15 dated 04.01.2013 and the petitioner was acquitted of criminal charges in C.C.No.21of 2010 vide judgment dated 28.06.2010 passed by the II Metropolitan Magistrate, Cyberabad at L.B.Nagar. Therefore, learned counsel for the petitioner submitted that appropriate orders be passed in the writ petition directing the respondents to consider the case of the petitioner for promotion to the post of Administrative Officer with all consequential benefits.

Learned Government Pleader appearing for the respondents had drawn attention of this Court to the counter affidavit, wherein the respondents have admitted that the case of the petitioner for promotion to the post of Administrative Officer would be considered based on the seniority list dated 27.07.2018. In view of the above, this Court is of the considered view that this writ petition can be disposed of directing the respondents to consider the case of the petitioner for promotion to the post of Administrative Officer strictly in terms of the seniority list dated

27.07.2018 and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. With the above directions, the writ petition is disposed of. No order as to costs.
