THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12987 of 2025 ORDER:

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner in Crime No.76 of 2025 before the Central Crime Police Station, Hyderabad. 2.

The brief facts of the case are that a complaint was lodged on 01.07.2025 by Mrs. G. Lakshmi, Director of the A.P. Raja Rajeswari Mahila Co-operative Urban Bank Ltd., alleging that the former Managing Director, Anil Maloo, along with employees A. Durga and Nekunapuram Neeraja Gayatri, had created fictitious gold loan accounts, forged documents, and misappropriated large sums of bank funds. The investigation revealed that the accused had fabricated records and siphoned off money for personal gain.

Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner was falsely suspected based solely on the alleged confessional statements of the co-accused, which are inadmissible in evidence and unsupported by any corroboration and that the petitioner was neither named in the complaint nor mentioned in the remand report, and there was no documentary or oral evidence connecting him to the offences. He further submitted that the main accused had already admitted their guilt through a Memorandum of Understanding dated 16.05.2025, thereby exonerating the petitioner. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor submitted that the name of the petitioner was not mentioned in the complaint. Further, the investigation was not yet completed. Therefore, he prayed the Court to pass appropriate orders.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the name of the petitioner was neither mentioned in the FIR nor in the remand report and that his alleged involvement is based only on the statements of the coaccused, which require further corroboration during the course of investigation. There is no material, at this stage, to indicate his direct participation in the alleged offences. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, PS CCS, DD,EOW, Team - VIII, Hyderabad, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the

Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required 7.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
