HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE P. NAVEEN RAO Writ Appeal No.442 of 2016 PC:(Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

Having regard to the controversy raised in the writ petition and the order passed by learned Single Judge, Mr. K. Ramachandra Reddy, learned counsel holding for Mr. G. Narender Reddy, Advocate on record for the appellant submits that the appellant-Gram Panchayat may be permitted to conduct fresh auction by following the due procedure. He submits that the appellant shall complete the process of fresh auction within a period of two to three weeks, and in any case, within four weeks from today. Mr. N. Naveen Kumar, learned counsel appearing for respondent Nos. 1 to 38, on instructions, submits that these respondents have no objection for conducting fresh auction, and in which case, they be permitted to participate in the auction. It is needless to mention that not only these respondents, but any other person, who is interested in participating in the auction process has every right to participate in the auction.

Learned counsel for the appellant submits that the appellant shall allow all the respondents or any other persons, who are interested in participating in the auction process. His statement is recorded and accepted. We direct the appellant to conduct auction in the presence of District Panchayat Officer, Nalgonda District. We direct the District Panchayat Officer, Nalgonda District, who is respondent No.40 herein, to remain present at the time of auction. We also direct the concerned authorities to video record the entire auction process. In the circumstances, the order impugned in the present appeal renders ineffective.

The writ appeal is accordingly disposed of.

Consequently, pending miscellaneous petitions shall also stand closed.
