HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.8627 of 2018 ORDER :

This criminal petition filed under Section 438 Cr.P.C. by the petitioners/A.1 to A.4 in Crime No.36 of 2018 of Uppalaguptam Police Station, East Godavari District, dated 10.04.2018, registered for the offence punishable under Section 174 Cr.P.C. 2.

The investigation is still pending. The petitioner moved for anticipatory bail before the learned II Additional District and Sessions Judge, East Godavari at Amalapuram, in Crl.M.P.No.843 of 2018, that was ended in dismissal on 09.07.2018.

Heard learned counsel for the petitioners and learned Public Prosecutor, representing the State, and perused the material on record. 4.

There is nothing to say that specific accusation so far as the petitioners concerned for anticipatory bail, much less any apprehension of arrest. It is in fact Postmortem examination report mentioned as R.F.S.L. report is awaiting as to the death is by committing suicide or any anti-mortem injuries are there of any human agency in committing the murder, without which there is nothing to consider the application. However, it is not a bar for future renewal of request to decide on own merits from changed circumstances.

Accordingly, the criminal petition is dismissed.
