THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39969 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against him in Crime No.136 of 2016 on the file of Central Crime Station, Hyderabad, for the offences under Sections 420, 406 read with Section 34 I.P.C. Heard and perused the material available on record. It is stated in the affidavit that except the fact that petitioner is elder brother of A2, he has no other role to play in the entire issue. The petitioner has nothing to do with the alleged company floated by A1 and he does not even know the complainants and never approached them for investing any money. The entire complaint does not speak about any role attributed to petitioner.

A1 and A2 were recently arrested and even in the remand case diary of the said accused, there is absolutely nothing against the petitioner. The petitioner filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation. However, taking into consideration the facts and circumstances of the case, this Court is of the view that the investigation can be completed without arresting the petitioner. Accordingly, respondent No.2 is directed to complete the investigation and file a final report in the above Crime, in accordance with law in either way, without arresting the petitioner.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
