THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.35586 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the fourth respondent in not granting leasehold rights in the tanks, which fall under the area of operation of the petitioner society by fixing the upset price in favour of the petitioner society as illegal and arbitrary.

At the time of hearing, learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the writ petition with a liberty to make fresh application to the fourth respondent for grant of leasehold rights.

In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case.

Permission as sought for is granted.

Hence, the Writ Petition is dismissed as withdrawn granting liberty to the petitioner to make fresh application to the fourth respondent for leasehold rights. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
