HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8533 of 2015 ORDER:

This petition is filed by the petitioner-accused No.2 under Section 482 Cr.P.C. seeking to modify the order dated 13.7.2015 in Crl.M.P.No.1948 of 2015 on the file of the Court of II Additional Chief Metropolitan Magistrate, Hyderabad.

Heard and perused the material available on record. The petitioner filed the above Crl.M.P. before the Court below for return of passport deposited in the Court. The Court below granted custody of the passport to the petitioner for the purpose of verification only and imposed a condition to furnish a local surety for a sum of Rs.5 lakhs for obtaining the said passport. Aggrieved by the said condition, the petitioner filed this petition seeking to modify the said condition. Learned Counsel for the petitioner submitted that the said condition is onerous in nature and the same may be modified. Considering the facts and circumstances of the case, the petitioner is directed to execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with one surety for the like sum to the satisfaction of the Court below, instead of furnishing local surety for a sum of Rs.5 lakhs.

With the above modification, the Criminal Petition is disposed of.
