Accordingly the matter was directed to be listed under the caption 'for appearance, today. Today, though the matter is listed under the caption 'for appearance' none appeared for the appellant nor is representation made on his behalf in the forenoon as well as afternoon. In the circumstances, this Court has left with no other option except to dismiss the appeal for default. Civil Miscellaneous Appeal is dismissed for default.
