The grievance of the petitioner was that the police authorities were calling him to Osmania University Police Station and harassing him and his family members without reason.

The Inspector of Police, Osmania University Police Station, Hyderabad, filed a counter-affidavit stating that upon the complaint made by one Hemanth T. Pandya, proprietor of M/s. RK Tours and Travels, MG Road, Secunderabad, Crime No.9 of 2012 had been registered on the file of Osmania University Police Station under Section 392 I.P.C. In the course of investigation of this crime, the petitioner was summoned to the police station for interrogation. He however denied any involvement in the case and he was accordingly let off. The Inspector further stated that except for the purpose of his examination, the police did not require the petitioner to attend the police station. His allegation that the police authorities had harassed him or his mother was denied.

In the light of the counter-affidavit averments which remained unrebutted, it is clear that the police had just cause to interfere with the petitioner as his interrogation was warranted in a pending criminal investigation. Needless to state, the police authorities are bound to abide by the due procedure prescribed by law in the course of carrying

out such investigation and taking steps thereafter. Subject to the above observation, the writ petition is dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
