THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.811 of 2016 ORDER:

As it is stated that the petitioner's representation dated 02.01.2016 is pending consideration before the authority concerned, in relation to release of its seized vehicle bearing registration No.KA 40 F 1017, it is not necessary for this Court to keep the present writ petition pending and adjudicate the same on merits. It is for the authority concerned to apply its mind and take appropriate action in the matter. The writ petition is accordingly disposed of directing the authority concerned to consider the petitioner's representation dated 02.01.2016 in accordance with law and take appropriate action in the matter.

In the event, the authority concerned directs release of the subject vehicle, it shall be open to him to impose such conditions as are deemed fit and proper including deposit of a reasonable amount as assessed by him and also an undertaking to the effect that the petitioner shall not alienate the vehicle or encumber it pending further enquiry, if any. This exercise shall be completed expeditiously and in any event, not later than four days from the date of receipt of a copy of this order.
