THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12989 of 2025 ORDER:
This Criminal Petition is filed seeking the Court to enlarge the petitioner, on bail, who is arrayed as accused in Crime No.81 of 2025 of Meerpet Police Station, Rachakonda Commissionerate.
2.
The brief of the case are that a complaint lodged on 18.01.2025 by the de facto complainant stating that her eldest daughter, Smt. Venkata Madhavi, left her residence at Plot No.3, New Venkateshwara Colony, Jillelaguda, Balapur, at about 12:00 hours on 16.01.2025 after a quarrel with her husband. Despite extensive search efforts, she could not be traced. Basing on the said complaint, a case in FIR No.81/2025 under the head "Woman Missing" was registered at Meerpet Police Station. During investigation, the petitioner was arrested on 28.01.2025 on suspicion of involvement in the disappearance of the missing woman.
3.
Heard Sri Gadipe Prasanth, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar,
learned Additional Public Prosecutor appearing on behalf of the respondent - State.
4.
Learned counsel for the petitioner submitted that the entire case was based on circumstantial evidence without any eyewitness, recovery, or forensic link connecting the petitioner to the alleged offence and that no dead body had been recovered, the alleged confessions were inadmissible, and the so-called forensic findings were inconclusive. He further submitted that the petitioner is a retired ex-serviceman with no criminal antecedents, had cooperated during the investigation, and the final charge sheet had already been filed. Hence, further detention served no purpose. He contended that the petitioner had been in custody since 28.01.2025. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor submitted that there are serious allegations against the petitioner. He further submitted that the investigation has been completed and the charge sheet has also been filed. Therefore, he prayed the Court to direct the trial Court to conclude the trial and pass appropriate orders.
6.
In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the allegations leveled against the petitioner are serious and heinous in nature. Further, the earlier bail petitions filed by the petitioner were dismissed, and the investigation has been completed and the charge sheet has also been filed. Considering the facts and circumstances of the case, this Court deems it fit to direct the trial Court to conclude the trial at the earliest and dispose of the matter as expeditiously as possible, in accordance with law.
7.
With the above direction, this Criminal Petition is disposed of.
Miscellaneous applications, if any pending, shall stand closed.
