Heard learned counsel for the parties.

This public interest litigation (PIL) basically challenges para II of G.O.Ms.No.10, Housing (RH&C.A1) Department, dated 15-10-2015 being arbitrary and illegal.

On last occasion, when we heard learned counsel for the parties, we expressed our reservation about para II of the said Government Order. Today, Sri Sharath, learned Special Government Pleader placed on record G.O.Ms.No.12, dated 26-11-2015 amending para II of G.O.Ms.No.10. We have perused the amendment. Sri Satyam Reddy, learned Senior Counsel appearing for the petitioner is also satisfied with the amendment made to G.O.Ms.No.10. In view thereof, nothing survives insofar as first objection is concerned.

Sri Satyam Reddy submits that insofar as para V is concerned, the petitioner would be satisfied if observations are made that Engineering Department that will be selected by the District Collector in the district to execute Two Bed Room Housing Programme shall complete the same expeditiously and the houses that would be constructed conforms the standards stipulated in this behalf. In the circumstances, we dispose of this PIL by the following order: "The District Collector shall select the Engineering Department in his district which would be capable enough to execute Two Bed Room Housing Programme and shall maintain standards as prescribed and so also complete the scheme expeditiously.

If the petitioner finds that the concerned Engineering Department is not doing the job either expeditiously or the construction is not up to mark, it is open for him to take appropriate remedy against them." Miscellaneous petitions, if any, also stand disposed of.
