THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.P.M.P.No. 3061 of 2015 in Crl.P.No. 1979 of 2015 and Crl.P.No.1979 of 2015 Common Order:

The de-facto complainant Ms. M. Sharada Devi and her counsel Sri K. Venkateswara Rao are present. Accused 1 & 2 and their counsel Ghantasala Udaya Bhaskar are present.

2. Heard both sides.

3. On the complaint of de-facto complainant, the Police of KPHB Colony Police Station, Cyberabad registered a case in Crime No. 1059 of 2014 against the accused for the offences under Sections 427 & 447 IPC and under Section 3(1) (v) of SC & ST (Prevention of Atrocities) Act, 1989. The allegation is that on 1.10.2014 at about 6 a.m the accused trespassed into the complainant's house situated in Nizampet village KPHB Colony and damaged the wall of the said house and when complainant and her husband questioned and asked about their right of trespass into the house the accused went away and again on 8.10.2014 the accused along with their men came to the house of the complainant and damaged the room and compound wall and when questioned they abused the complainant and her husband by their caste. Investigation is reported to be pending.

While so, the complainant, accused along with their counsel are present before the Court and submitted that at the intervention of elders, both the parties have amicably settled their civil dispute and therefore she has no objection for quashment of proceedings against them in Crime No. 1059 of 2014 on the file of KPHP Colony Police Station, Cyberabad and hence, this court may be pleased to accord permission to them to compound the offence and quash the proceedings in the interest of justice.

5. Having regard to above submission and in view of the fact that predominantly it is a property dispute wherein the parties amicably settled the disputes

between them and also considering that no useful purpose will be served even if they are driven to trial, since chances of security conviction are bleak and following the decision reported in Gian Singh vs. State of Punjab and another (2012) 10 SCC 303) compromise is recorded in terms of accompanying compromise petition and consequently the proceedings in Crime No. 1059 of 2014 on the file of KPHB Colony Police Station, Cyberabad are quashed as per the joint compromise memo filed by the parties.

6. In the result, both the petitions are accordingly allowed.
