THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.20387 of 2008 ORDER:
This writ petition is filed seeking the following relief: " to issue a Writ, order or direction more fully in the nature of writ of Mandamus directing the respondents herein to take the services of the petitioner as the contract labour with effect from 01.10.1982 instead of 01.04.90 for the purpose of seniority in the category of JPA and for further promotions as Plant Attendant and other higher categories by declaring the proceedings Lr.No.CEE/ O&M/ Dr.NTTPS/ Adm./ C5/ D.No.166 0/ 08 dated 11/ 11/ 2008 of the respondent as illegal, improper, arbitrary and violation of Article 14 of Constitution of India and pass such other order or orders as this Hon'ble Court deems fit and proper in the case."
When the matter is taken up for hearing, it is noticed that at the time of admission, this Court passed interim orders on 18.9.2008 directing the respondents to consider the case of the petitioner for the post of Plant Attendant by taking his total service as contract labourer into consideration from 1.10.1982, if the same is permissible as per law, and to pass appropriate orders.
It has been informed by the learned standing counsel that the case of the petitioner was considered and rejected and the petitioner has not challenged the said rejection orders. Considering the submission made by the learned standing counsel, this Court is of the opinion that the cause in the writ petition does not survive.
Accordingly, the Writ Petition is dismissed as infructuous. However, liberty is given to the petitioner to challenge the rejection order. No order as to costs.
