Heard learned counsel for petitioner and learned counsel for respondents.

Even after issuance of notice before admission on 18.08.2017, no counter affidavit is filed.

It is the case of the petitioner that he has ancestral properties of an extent of Acs.0.41 cents in Survey No.86-2A/2D, Acs.0.83 cents in Survey No.56-2B and Acs.0.80 cents in Survey No.56-2E. When the respondents 3 and 4 proposed to lay a road encroaching the land of the petitioner without following any law, the present writ petition is filed. As stated above, this Court while issuing notice before admission on 18.08.2017, granted opportunity to the respondents to file counter affidavit. This Court also directed the respondents not to interfere with the possession of the land of the petitioners without following due process of law. Since the respondents did not file counter affidavit, the interim order, dated 18.08.2017 directing the respondents to follow due process of law if they want to take possession of the land is made as final order. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs.
