HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.24698 OF 2016 ORDER:

Heard.

2. Questioning the action of the Tahsildar-2nd respondent in not considering the representations of the petitioner dated 27.05.2016 and 06.07.2016 for issuance of No Objection Certificate for providing Electricity Service Connection to the new bore well dug in R.S.No.213/6 of Singagudem Village, Lingapalam Mandal, West Godavari District, the present writ petition is filed.

3. The case of the petitioner is that he is the owner, possessor and pattadar of land in Survey No.64 and R.S.No.213/6 of Singagudem Village, Lingapalam Mandal. With the permission of the revenue authorities, he dug a Bore well in his agricultural Land in Survey No.64 and an electricity connection was also provided to the said land.

As the ground water has completely exhausted in the said bore well, petitioner made an application to the Tahsildar to accord permission for digging of Bore Well in his land in Survey No.213/6 and also for shifting of Electricity Service Connection from old Bore Well in Survey No.64 to the New Bore well in R.S.No.213/6 of Singagudem Village, Lingapalam Mandal, West Godavari District. As the respondents have not taken any action on his request, petitioner has approached this Court by filing W.P.No.9523 of 2016, which was disposed of at the admission stage by order dated 23.03.2016. Pursuant to the said order, petitioner made representations dated 27.05.2016 and 06.07.2016 to the 2nd respondent for issuance of No Objection Certificate. Hence, the present writ petition.

In the facts and circumstances of the case, I deem it appropriate to dispose of the writ petition directing the respondents to consider the representations of the petitioner dated 27.05.2016 and 06.07.2016 for issuance of No Objection Certificate for providing Electricity service connection to the New bore well dug in R.S.No.213/6 of Singagudem Village, Lingapalam Mandal, West Godavari District, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. With the above direction, the Writ Petition is disposed of. As a sequel, the miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in the light of this final order.

No order as to costs.
