THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.10557 of 2016 ORDER:

The petitioner, who is an accused in crime No.25 of 2016 of Hussainialam Police Station, Hyderabad District, filed the present Criminal Petition under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with the above crime, registered for the offences punishable under Sections 419 and 384 of Indian Penal Code.

The facts in issue disclose that on 06.02.2016 one Sunitha Krishnan, General Secretary, Prajwala, lodged a report stating that on 06.02.2016 one Nazeema was granted permission by VIII Additional Chief Metropolitan Magistrate to meet her father Shaik Moinuddin. It was further alleged that during such meeting, it was brought to the notice of the informant that some people impersonating as Prajwala staff have visited their house and extorted Rs.4,000/- for release of the victim. On enquiry, said Shaik has given the name as Ahmed, who is the petitioner herein, as the person who collected money. It is further alleged that petitioner and three others demanded Rs.12,000/- for release of the victim. Basing on these allegations the present report is lodged. Heard the learned counsel for the petitioner as well as the learned Public Prosecutor.

A perusal of the averments in the report disclose that the petitioner is alleged to have collected money by impersonating himself as staff of Prajwala to get the victim released from Prajwala Home. Having regard to the nature of allegations made, which in my view are grave and serious in nature, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, the Criminal Petition is dismissed. _______________________________ JUSTICE C.
