THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.222 of 2010 ORDER:

None appears for the petitioners.

The relief sought for in this writ petition is to declare the action of the respondents, in trying to lay a gravel road across the subject land, as illegal and arbitrary.

While an order was passed, in WPMP.No.242 of 2010 dated 11.01.2010, granting interim suspension for a period of four weeks, the said interim order was not extended thereafter. In the counteraffidavit, filed along with the petition to vacate stay, the respondents stated that a road was already laid in the year 1994 itself. In the absence of any interim order, for the past more than seven years, and as the respondents state that a road was laid in the year 1994 itself, I see no reason to grant the relief sought for in this writ petition. The Writ Petition fails and is, accordingly, dismissed. Miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
